Effect this measure will have on costs and revenues of state government.


The purpose of proposed Senate Bill 57 is to enhance maintenance and repair of the State’s roads and highways generally. The Bill establishes roads accountability and transparency. The Bill also directs the State Auditor to develop and maintain a searchable website of funding actions and expenditures relating to State and public roads. The Bill sets forth the minimum content to be contained within the website. The Bill directs the Commissioner of Highways to provide information and data to the State Auditor. The Bill requires an annual update to the Joint Committee on Government and Finance. The Bill creates the Special Road Repair Fund as a subaccount of the State Road Fund. The Bill also authorizes the Commissioner of Highways to transfer certain funds into the subaccount for certain purposes. The bill creates the Enhanced Road Repair and Maintenance Program. The Bill states legislative finding and purpose of program. Also, the Bill requires Division of Highways' county supervisors to consult with county commissions and legislators to submit project requests to the Division of Highways. The Bill sets forth a funding formula. The Bill also sets forth requirements concerning bidding, vendors, and contracts with private vendors. The Bill also specifies uses of the Special Road Repair Fund. The Bill goes on to define terms. The Bill provides requirements for the Commissioner of Highways and its Districts. The Bill sets out rulemaking requirements. Lastly, the Bill requires reporting by the Division of Highways and the Legislative Auditor.

Explanation of above estimates (including long-range effect):


The proposed legislation calls for the development by the State Auditor of the Country Roads Accountability and Transparency Website. This particular transparency website or a very similar version of it was previously mandated by House Bill 4017 (2020 Regular Session) which was passed by the West Virginia Legislature and signed into law by the Governor. We have examined the provisions of proposed Senate Bill 57 and it is the opinion of the State Auditor’s Office that should the proposed Bill become law, the State Auditor’s Office could implement the Bill’s provisions which are solely under the control of the State Auditor’s Office using current employees and resources and we would anticipate no additional development costs related to the Website which is currently functional and no additional long-term continuing costs to the State Auditor’s Office in order to maintain and update the Site. Accordingly, the financial impacts reflected in our Fiscal Note Submission pertain only to the proposed Bill’s impact on the budgetary accounts of the State Auditor’s Office.

Other provisions in the proposed Bill would directly impact the West Virginia Division of Highways (WVDOH) and we would recommend the Legislature submit a Fiscal Note Request to the WVDOH, if such a request has not yet been sent.
