Effect this measure will have on costs and revenues of state government.


Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. HB 4826 will have no impact on costs and revenues of state government. HB 4826 explicitly adds "e-sports" to the definition of "sports event" codified in W. Va. 29-22D-3(15) and also defines "e-sports" in the same section. The practical effect of such is that it explicitly permits wagering on e-sports with no discretion of the director to wholly prevent wagering on the same pursuant to 179 CSR 9-7.1. However, the Lottery Director would retain discretion under 179 CSR 7.1 to limit wagers in certain situations consistent with public policy if there is a gap between the operator/management service provider house rules and what is statutorily permissible (eg - u18 amateur e-sports participants). Currently, "e-sports" is authorized to be wagered upon in the State as an "other special event authorized by the commission under this article" as referenced in W. Va. Code 29-22D-3(15). Additionally, seven of nine sports wagering "skins" have requested and been given approval to offer wagering on e-sports in West Virginia (Approved: Barstool Sports, BetMGM, Caesars, Draft Kings, Fanduel, Kambi, PointsBet) (Not Approved: Golden Nugget, Betly).
