Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to add "sexual orientation" and "gender identity" to the categories covered by the Human Rights Act, prohibiting discrimination in employment and places of public accommodation. The bill adds "age", "sexual orientation" and "gender identity" to the categories covered by the Fair Housing Act prohibiting discrimination in housing. The bill defines "sexual orientation" and "gender identity". The West Virginia Human Rights Commission already enforces the Human Rights Act and the Fair Housing Act in accord with the United States Supreme Court precedent established by Bostock, and in accord with similar guidance from the US Equal Opportunity Commission and US Department of Housing and Urban Development to include claims alleging discrimination based on sexual orientation and gender identity. No increase in the amount of complaint volume is anticipated as a result of the proposed legislation.

Memorandum


The reasoning for adding "age" to the protected classes under the Fair Housing Act is not clear, and is not in accord with the federal Fair Housing Act. WV Human Rights Commission does not recommend adding "age" to the list of protected traits under the Fair Housing Act.
