Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to prohibit awarding or renewing state contracts to vendors who are owned, in whole or part, by state officials or their family members. It requires an affidavit of compliance with the prohibition to be submitted to the Purchasing Division. It requires the Ethics Commission's review and approval of exemptions to the prohibition. Since the bill requires the vendors to submit the affidavit, there should be no fiscal impact to the Purchasing Division for implementation. Additionally, there should be no additional costs to the Ethics Commission as long as there are a minimal amount of exemptions requested on an annual basis. Therefore, the passage of this bill will have no fiscal impact on the State of West Virginia.

Memorandum


The Purchasing Division would not have the ability to determine relationships with all vendors doing business with the State without the required affidavit of compliance. Additionally, by having the Ethics Commission review any exemptions to this prohibitation, there may be some delay of awarding a contract pending a decision by the Ethics Commission. If the lowest bidder is disqualified due to this prohibition, the bid would go to the next bidder, which would increase the costs. The number of contracts that would be affected or the increase in costs is unknown.
