Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to permit persons who are twenty-one years of age or older to operate or be a passenger on a motorcycle without a helmet. Research of this issue indicates passage of this bill will create increased claims costs for the plan. The amount of the increased claim costs go beyond health insurance plans like PEIA, they are also incurred by the automobile/motorcycle insurance. PEIA’s ability to identify actual claim data was also limited since claims information identifying cause as motorcycle was not readily available until recently.
A Connecticut Study indicated motorcycle wreck claims without a helmet result in 85% higher medical costs than those with a helmet.
Additional research from the U.S Department of Transportation-National Highway Traffic Safety Administration (USDOT) indicates helmet nonuse results in $1.2 billion of economic loss in the United States. Applying this on a per motorcycle basis, it results in $144 per motorcycle.
Incorporating both the Connecticut study and the USDOT research and applying it to WV’s 57,900 registered motorcycles, and further reducing to PEIA plan members, increased costs as a result of non-helmeted riders are estimated to be $750,000 to $1 million per year.
