It is difficult to determine the fiscal impact of this proposed legislation. The Bill does not specify the scope or timeframes for the inspection of trees. It also does not specify which entity is responsible for the removal of the trees so marked. It does not specify which agency is responsible for training costs or if those costs will be shared. If the language in the bill would be interpreted to create a statewide responsibility for the WVDOC to inspect every state road or highway and perform the removal of the appropriate trees, it could have a very large fiscal impact.
