Effect this measure will have on costs and revenues of state government.


The bill requires the Purchasing Director to establish standards and propose rules requiring uniforms made in the United States, and would require purchases made after June 30, 2016 of United States-made uniforms. Some concerns include the possibility of cancellation of existing contracts and rebid in order to comply with the legislation. The legislation, as written requires these standards to affect, at a minimum, employees of the boards and agencies identified in ยง5F-2-1. If the bill were enacted, the Purchasing Division would develop regulations requiring all contracts issued by the Purchasing Division for the purchase of uniforms include a provision that the uniforms be made in the United States, but the exact meaning of the language requirement the development of the regulation is unclear. The Purchasing Division does not have the knowledge or expertise necessary to address what would constitute "made in the United States." It is difficult to determine price fluctuations related to purchases as our purchasing staff is not knowledgeable I the garment industry, but rather in procurement laws, rule and procedures relating to state procurement.

The Department of Administration is unable to determine any costs associated with the enactment of the proposed legislation.



Memorandum


The bill is unclear as to what "Made in the United States" entails. This bill, as written, would not address the agencies exempt from Article 3 of Chapter 5A. As a result, any agencies that utilize uniforms would not be required to follow the regulation, such as Higher Education or Regional Jails. Currently, the following are some of the agencies that contract to buy uniforms: Department of Agriculture, Division of Corrections, Department of Environmental Protection, Division of Natural Resources, Division of Highways, State Police, Division of Juvenile Services, Division of Forestry and the Public Service Commission.
