Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

The purpose of this bill is to require the Department of Health and Human Resources to seek a federal waiver of the thirty day notice requirement for a woman to receive a tubal ligation. If the Waiver required in the proposed legislation were granted by CMS, there is a possibility that more members would elect the sterilization procedure described, which could potentially increase utilization and payments. Sterilization coverage is described in the Medicaid Provider Manuals, section 519.15.2- Sterilization, which includes a description of situations in which the 30-day waiting period may not be required. However, there is not reliable data available to estimate whether more members would choose to have sterilization procedures if the 30-day waiting period was not required or the timing of additional costs, if any, that could result.
