Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to require the Department of Health and Human Resources to seek a federal waiver of the thirty day notice requirement for a woman to receive a tubal ligation.
If the Waiver required in the proposed legislation were granted by CMS, there is a possibility that more members would elect the sterilization procedure described, which could potentially increase utilization and payments. Sterilization coverage is described in the Medicaid Provider Manuals, section 519.15.2- Sterilization, which includes a description of situations in which the 30-day waiting period may not be required. However, there is not reliable data available to estimate whether more members would choose to have sterilization procedures if the 30-day waiting period was not required or the timing of additional costs, if any, that could result.
