Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The Division of Personnel (DOP) would incur significant costs to hire and house the human resources (HR) staff currently housed within agencies. The DOP is a regulatory agency and does not perform the HR tasks being performed by employees in the agency. When DOP was created in 1989, and as provided in the 2007 centralization report to the legislature in response to SB 746,it was determined that the agencies need HR staff on site to perform essential services, centralization would negatively impact and possibly delay provision of personnel services, and the personnel structure within WV state government is comparable to that in the majority of other state governments. It is anticipated that DOP would need to significantly increase the fees assessed to agencies for services in order to cover the additional costs.

Explanation of above estimates (including long-range effect):


DOP is unable to provide an accurate assessment for the following reasons: 1) It is unclear what types of services are considered "personnel". For example, this could include payroll, personnel transactions, employee relations, training, benefits, EEO, ADA, workers' compensation, unemployment, timekeeping, etc. 2) The number of staff impacted cannot be calculated based on item 1 above. Many employees in the agencies may perform HR functions as only a part of their job. 3) The costs of rent, equipment, etc. cannot be calculated for the reasons above.

It is unclear what is meant by "personnel sections or divisions". Many types of work may be considered "personnel" in nature.
