Explanation of above estimates (including long-range effect):


We are unable to evaluate the potential full and complete fiscal impacts to affected municipal governments who are already currently participating in the Municipal Home Rule Pilot Program. However, the real possibility exists that adoption of the legislation would impact municipal governments participating in the Program in terms of reducing their revenues and the associated expenditures as fees and/or taxes authorized by ordinances adopted under the Program ended.



Memorandum


Under the current provisions of Chapter 8, Article 1, Section 5a of the West Virginia Code, municipal ordinances enacted pursuant to the Municipal Home Rule Pilot Program (MHRPP) may remain in effect, subject to the requirements of the provisions of that section, until the ordinances are repealed. We believe the future status of ordinances which have been adopted under the MHRPP would not be clear, assuming adoption of proposed House Bill 4420. Our reasoning is centered on the full repeal of the Code citation under the proposed legislation which included the language noted above which provided for municipal ordinances which were adopted under the MHRPP to be able to continue in full effect until repealed.
