Effect this measure will have on costs and revenues of state government.
This bill would create a new criminal offense of living within 1,000 feet of a school or childcare facility if the person is required to register as a sex offender. The West Virginia Division of Corrections and Rehabilitation cannot predict how many offenders may be sentenced to our custody as a result of this legislation. However, for each offender who is sentenced, the State of West Virginia can expect an additional cost of $25,879 per year they are incarcerated (average annual cost per offender in FY2018). Since the penalty provided in this legislation has a minimum of two years the minimum cost would be $51,758 per offender.
The bill also calls for the use of GPS monitoring for sex offenders on supervision who had committed their crime against a minor. The WVDCR does not anticipate a significant increased cost due to this provision as GPS is already commonly used for high risk sex offenders being supervised by WVDCR Parole Services.
