This piece of legislation would allow more individuals an opportunity to seek an expungement. This would require additional staffing in the Criminal Records section of the West Virginia State Police at a cost of approximately $133,539 in order to process the additional caseload.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. The above fiscal detail consists of the cost of two office assistants and one fingerprint technician with the appropriate workstations. The increase in revenue due to the additional requests is unknown.

Actual Expungement Cases in last three years: 2016CY = 1162 2017CY = 1677 2018CY = 1459 There is not a direct correlation between number of requests and revenue received since it is commonplace for fees to be waived at the Circuit Court level.
