Effect this measure will have on costs and revenues of state government.
As of June 30, 2018 the WV Division of Corrections and Rehabilitation had 440 offenders serving 1- 15 year prison terms with the most serious offense of Burglary. This constituted approximately 6% of our offender population. Also, in FY2018, 2013 new offenders were sentenced for this same crime.
Although we do not have information that would describe how many of these offenders would receive the enhanced penalties provided for by this legislation, Burglary represents a significant portion of our population and sentence increases could have a significant fiscal impact on the WVDCR.
For example, if 25% of the 213 new Burglary offenders would end up spending one additional year in prison it would cost the State $1,378,056 ($25,879 average cost per inmate in FY2018 x 25% of 213).
