Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to set forth the amount the West Virginia Public Employees Insurance Agency will reimburse air-ambulance providers for the transportation of individuals covered by its plans, consistent with Air Evac EMS, Inc. v. Cheatham, 910 F. 3d 751 (4th Cir. 2018). PEIA has reviewed this bill and determined there is no fiscal impact. However, there remains concern over the current practice of air-ambulance providers billing the remaining balance (charged amount, less PEIA reimbursement) to PEIA members. PEIA maintains the position the air ambulance providers are charging exorbitant rates under the protection of Federal Aviation Agency law. PEIA will continue to negotiate with out of network air ambulance providers to stop this practice until this issue is resolved at the Federal level.
