House Bill 3020, if enacted, would allow the Higher Education Policy Commission, the Council for Community and Technical College Education and institutional governing boards to enter into sole-source contracts for goods and services with nonprofit corporations affiliated with the respective education institutions. The enactment of this bill would not result in an additional need for appropriations. The nonprofit corporation’s sole source designation could increase costs because the available information regarding the competitiveness of its offers would be reduced. Financial controls could also be weakened by a potential reduction in oversight by the Auditor’s Office and the Attorney General’s Office. It would also be possible for the institutions to procure a large portion of its materials, goods, equipment, services, printing, facilities, or financial services from the nonprofit corporations on a sole-source basis.
