Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to provide for fair pay and maximized employment of disabled persons; create a state “Employment First” policy that encourages agencies to facilitate employment of disabled persons; establish a task force to initiate these policies; provide for the DHHR Bureau for Behavioral Health, Division of Rehabilitation Services, Department of Education, DHHR Bureau for Medical Services (State Medicaid Agency) and Workforce WV to implement the policy; and remove current exemption for paying minimum wages to persons in nonprofit workshops. Currently there are 240 members on the Individual/Developmental Disabilities Waiver (IDDW) accessing Supported Employment. In order to access these job coaching services, the member must have a job paying at least minimum wage and it cannot be in a sheltered workshop setting. Per Centers for Medicare and Medicaid (CMS) §1915 (C) Waiver Instructions and Technical Guide regarding employment and employment related services, "Waiver funding is not available for the provision of vocational services delivered in facility based or sheltered worship settings, where individuals are supervised for the primary purpose of producing goods or performing services." Job coaching services are not available to individuals not on the IDD Waiver. The Department anticipates no additional costs due to the proposed bill.

Memorandum


The bill has a flaw in section 18-10P-3. The bill references the Bureau for Behavioral Health and Health Facilities, however due to reorganization should be the Bureau for Behavioral Health as indicated in the purpose of the bill.
