A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section designated §17A-2-26, relating to establishing requirements for a Division Motor Vehicles office or Division of Motor Vehicles Now kiosk to be present in a county; establishing definitions for this section; establishing conditions for a Division of Motor Vehicles office location to be within a county; establishing exemptions under certain conditions; establishing requirements for a Division of Motor Vehicles Now kiosk to be located in a county; establishing the total number of Division of Motor Vehicle offices in this state; establishing the maximum number of Division of Motor Vehicle Now kiosks are to be determined; and requiring the provisions of this section be implemented by July 1, 2021.

Be it enacted by the Legislature of West Virginia:


article 2. division of motor vehicles.

§17A-2-26. Division of Motor Vehicle office locations; DMV Now kiosks.

(a) For purposes of this section:

“Division of Motor Vehicles office location” means a physical office in a county operated by the Division of Motor Vehicles and provides a full range of Division of Motor Vehicles services.

“Division of Motor Vehicles Now kiosk” means a kiosk that provides a limited range of Division of Motor Vehicles services, including vehicle registration renewals, driver’s license renewals, driver license record, and duplicate registration cards.

(b) No county with a population of 25,000 or greater shall be without a county Division of Motor Vehicles office location to provide motor vehicle services consistent with chapter 17A, 17B, and 17D of this code: Provided, That this subsection shall not apply to any county with a population of 25,000 or greater that does not have a Division of Motor Vehicles office location and the county seat is less than 25.0 miles from an existing Division of Motor Vehicles office location.

(c) Any county with a population of less than 25,000 that does not have a Division of Motor Vehicles office location less than 25.0 miles from the county seat shall have a Division of Motor Vehicles Now kiosk installed at a location within the county determined to be the most efficient location by the Division of Motor Vehicles.

(d) The total number of Division of Motor Vehicles office locations shall not exceed 21 offices in this state.

(e) The total number of Division of Motor Vehicles Now kiosks are to be determined at a later date by the legislature or legislative rule pursuant to the provisions in §17A-2-9 of this code.

(f) The provisions of this section shall be fully implemented by July 1, 2021.

 

 

NOTE: The purpose of this bill is to required counties with a population 25,000 or greater have a Division of Motor Vehicles office location within in the county unless there is a Division of Motor Vehicles office location within 25 miles from the county seat; require counties with a population of less than 25,000 install a Division of Motor Vehicles Now kiosk unless the county seat is within 25 miles of a Division of Motor Vehicles office location; establishing the maximum amount of Division of Motor Vehicles office locations in this state; prescribing the maximum amount of Division of Motor Vehicles Now kiosks to be determined at a later date; and requiring the provisions of this code be implemented by July 1, 2021.
