A BILL to amend article six, chapter thirty-three of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section thirty-one-f, relating to automobile insurance; prohibiting insurance companies from discriminating on rates because driver under age of eighteen.

Be it enacted by the Legislature of West Virginia:
That article six, chapter thirty-three of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section thirty-one-f, to read as follows:
ARTICLE 6. THE INSURANCE POLICY.
§33-6-31f. Nondiscriminatory automobile insurance rates for
drivers under the age of eighteen.
No insurer, in determining rates to be charged for a policy or contract of bodily injury liability insurance or of property damage liability insurance, covering liability arising from the ownership, maintenance or use of a motor vehicle, may discriminate in any manner on the basis of an insured driver being under the age of eighteen years or, while residents of the same household, discriminate against the spouse of any such insured driver and relatives of either who are under the age of eighteen years: Provided, That insurers may adjust rates accordingly if an insured driver or, while residents of the same household, the spouse of any such insured driver and relatives of either who are under the age of eighteen years, have committed two fault based motor vehicle accidents within a period of twelve months.


NOTE: The purpose of this bill is to prohibit insurance companies from discriminating on rates charged for automobile insurance for drivers under the age of eighteen years.
