A BILL to amend article five, chapter thirty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twelve-c, relating to requiring pharmacists to place the discard date of prescription medicines on the prescription labels.

Be it enacted by the Legislature of West Virginia:
That article five, chapter thirty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twelve-c, to read as follows:
ARTICLE 5. PHARMACISTS, PHARMACY TECHNICIANS, PHARMACY INTERNS
AND PHARMACIES.
§30-5-12c. Expiration dates on prescription drugs.
Any person retailing, compounding or dispensing prescriptions or prescription drugs pursuant to this article shall place the discard date of the prescription drug on each prescription label. The discard date shall be the earlier of:
(1) One year from the date dispensed;
(2) The manufacturer's expiration date; or
(3) The date after which the drug product as dispensed should not be used.
