A BILL to amend article twenty-three, chapter eighteen of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended, by adding thereto a new section, designated
section twenty-five, relating to mandating that the West
Virginia University and Marshall University football teams
play each other annually beginning in the year one thousand
nine hundred ninety-nine, or sooner if the football
schedules of the respective universities permit; providing
that the game shall be played at West Virginia University
until the Marshall University stadium attains a comparable
seating capacity, and thereafter the game site shall be
rotated between the universities each year; providing for a
thirty percent ticket allotment to Marshall University until
the game site is rotated; and providing that each
university shall make a percentage of its ticket allotment
available to its students at a reasonably discounted student rate.
Be it enacted by the Legislature of West Virginia:
That article twenty-three, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
twenty-five, to read as follows:
ARTICLE 23. ADDITIONAL POWERS, DUTIES AND RESPONSIBILITIES OF
GOVERNING BOARDS OF STATE INSTITUTIONS OF HIGHER
EDUCATION.
§18-23-25. West Virginia University and Marshall University football teams to play annually.
The governing boards of West Virginia University and
Marshall University shall direct the athletic directors of the
respective universities to schedule annually a football game
between West Virginia University and Marshall University,
beginning in the year one thousand nine hundred ninety-nine or
sooner if the football schedules of the respective universities
permit. The annual game shall be played at West Virginia
University until such time that the Marshall University stadium
has attained a comparable seating capacity, and thereafter the
game site shall be rotated each year between the universities.
Until such time that the game site is rotated between the
universities, West Virginia University shall make available to
Marshall University for the game a ticket allotment equal to thirty percent of the total seating capacity of the West Virginia
University stadium. Each university shall make available to its
students a reasonably discounted student ticket, to be sold with
proper student identification from either university.
NOTE: The purpose of this bill is to mandate that the West
Virginia University and Marshall University football teams play
each other annually, beginning in 1999 or sooner if their
respective schedules permit.
