A BILL to amend article nine-a, chapter six of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section eight,
relating to allowing participation in public meetings by
video-teleconference.
Be it enacted by the Legislature of West Virginia:
That article nine-a, chapter six of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eight, to read as follows:
ARTICLE 9A. OPEN GOVERNMENTAL PROCEEDINGS.
§6-9A-8. Participation in meetings by video-teleconference.
Notwithstanding any other provision of law, a public body
may, by rule, provide a procedure to allow a member to
participate, including voting, in its meetings though video- teleconference. The rules may allow the participation by video- teleconference
only when the member is unable to attend due to a temporary medical condition of the member that prevents the
member from physically attending.
NOTE: The purpose of this bill is to allow members of
public bodies to participate in a body's meeting by
video-teleconference when a medical condition prevents the member
from attending.
