A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-13-3a, relating to requiring the Commissioner of the Division of Highways to provide adequate pull-off parking space along the state’s highway interstate system for those semitrailers and other vehicles that must stop at designated areas for weight, size or load limit inspection; and requiring rule-making.

Be it enacted by the Legislature of West Virginia:


ARTICLE 13. STOPPING, STANDING AND PARKING.


§17C-13-3a. Adequate parking along interstate highways.


(a) The commissioner shall ensure there is adequate pull-off parking space along the state’s highway interstate system for those semitrailers and other vehicles that must stop at designated areas for weight, size or load limit inspection required by state or federal law. Where adequate pull-off parking space is found not to exist, the commissioner shall with all deliberate speed cause any additional space to be constructed.

(b) The commissioner shall adopt and promulgate rules in accordance with the provisions of §29A-3-1 et seq. of this code.

 

NOTE: The purpose of this bill is to require the Commissioner of the Division of Highways to provide adequate pull-off parking space along the state’s highway interstate system for those semitrailers and other vehicles that must stop at designated areas for weight, size or load limit inspection. The bill requires rule-making.
