A BILL to amend article six, chapter three of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section five-a, relating to write-in candidates.

Be it enacted by the Legislature of West Virginia:
That article six, chapter three of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section five- a, to read as follows:
ARTICLE 6. CONDUCT AND ADMINISTRATION OF ELECTIONS.

§3-6-5a. Write-in candidate declaration of candidacy; write-in votes must be counted.

At least ten days before an election to fill any public office at which the voters of any county are entitled to vote, any person desiring to be a write-in candidate must submit a letter to the clerk of the county in which the election is to be held stating that such person desires to be a write-in candidate. These letters shall be kept on file by the clerk and only thosecandidates who have filed such a letter are eligible candidates.
All write-in votes received for properly declared candidates pursuant to this section shall be counted and reported in the regular manner as prescribed in this article.



NOTE: The purpose of this bill is to (1) require all write- in candidates to submit a letter to the county clerk declaring their intention to be a write-in candidate and (2) provide that all write-in votes for such candidates be counted and recorded.
