A BILL to amend article three, chapter sixty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
three, relating to authorizing the division of environmental
protection to promulgate a legislative rule relating to yard
waste composting.
Be it enacted by the Legislature of West Virginia:
That article three, chapter sixty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
three, to read as follows:
ARTICLE 3. AUTHORIZATION FOR BUREAU OF ENVIRONMENT TO
PROMULGATE LEGISLATIVE RULES.
§64-3-3. Division of Environmental protection; yard waste rules.
The legislative rules filed in the state register on the
eighteenth day of March, one thousand nine hundred ninety-seven,
relating to the division of environmental protection (yard waste
composting) are authorized.
NOTE: The purpose of this bill is to give the Director
discretion in certain instances to allow disposal of "domestic"
yard waste in landfills.
