A BILL to amend article five, chapter twenty-eight of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nine, relating to the West Virginia penitentiary; requiring
a convict to pay the costs of his or her imprisonment and
food; and creating a lien against real property owned by a
convict for such costs.
Be it enacted by the Legislature of West Virginia:
That article five, chapter twenty-eight of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section nine,
to read as follows:
ARTICLE 5. THE PENITENTIARY.
§28-5-9. Money earned while incarcerated to be used to pay costs
of food and imprisonment.
Notwithstanding any provision of law to the contrary, any
person committed to the penitentiary under a valid sentence of
imprisonment shall apply the money earned inside the penitentiaryto pay the cost of his or her imprisonment and food.
NOTE: The purpose of this bill is to require prisoners
confined in the West Virginia State Penitentiary to pay the costs
of their imprisonment and food with the money they earn while
working in the Penitentiary.
