A BILL to amend and reenact article three, chapter ten of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended, by adding thereto a new section, designated
section three, relating to requiring completion of the
veteran's memorial on the grounds of the state capitol
complex in Charleston.
Be it enacted by the Legislature of West Virginia:
That article three, chapter ten of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended and reenacted by adding thereto a new section, designated
section three, to read as follows:
ARTICLE 3. MONUMENTS, TABLETS AND MEMORIALS.
§10-3-3. Completion of veteran's memorial; findings and
declarations; memorial to be completed by July 1, 1995.
(a) The Legislature hereby makes the following findings and
declarations:
(1) Many courageous soldiers and military personnel have
represented this state in all domestic conflicts and foreign wars
since the creation and inception of this state;
(2) The sacrifices made by the men and women from West
Virginia that served this country in times of war and peace have
provided both peace and security to this state and to the nation;
(3) It is only fitting and proper that the veterans memorial
that was first provided for under the legislative enactment
embodied in article one-i, chapter twenty-nine, be completed in
order to honor all men and women who served this country in the
various branches of military service; and,
(4) Because the purposes for which said article one-i was
created have not yet been completed and realized and because the
construction of the veteran's memorial intended thereunder has
reached an apparent standstill, it is necessary to provide for
the completion of the memorial for veterans without further
adieu.
(b) The commissioner of culture is hereby directed to ensure
the successful completion of the veteran's memorial, as described
herein, subject to sufficient appropriation by the Legislature,
no later than the first day of July, one thousand nine-hundred
ninety-five.
NOTE: The purpose of this bill is to ensure completion of
the veteran's memorial at Charleston that was originally intended
to be fully funded by the voluntary tax check-off provisions of
article 1I, chapter twenty-nine. The bill directs that the
memorial be completed no later than July 1, 1995. It further
directs that the commissioner of culture ensure such completion
by such date.
