AN ACT to amend and reenact section four, article five-a, chapter
twenty-six of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to report of
tuberculosis cases; reducing reporting time from forty-eight
hours to twenty-four hours; and clarifying reporting
requirements.
Be it enacted by the Legislature of West Virginia:
That section four, article five-a, chapter twenty-six of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 5A. TUBERCULOSIS CONTROL.
§26-5A-4. Report of tuberculosis cases.
(a) Every physician practicing in this state, every public
health officer in the state, and every chief medical officer having
charge of any hospital or clinic or other similar public or private
institution in the state shall report in writing to the local department of health
in the patient's county of residence the name,
age, sex, race, home address and type of disease of every person
having tuberculosis who comes under his
or her observation or care.
Such report shall be made within
forty-eight twenty-four hours after diagnosis.
(b) Every local department of health shall forward all
reports of tuberculosis cases filed pursuant to this section to the
state department of health and human resources tuberculosis program
within twenty-four hours of receipt of such reports.
