A BILL supplementing and amending chapter six, acts of the
Legislature, regular session, two thousand six, known as the
Budget Bill, all supplementing and amending the
appropriation for the fiscal year ending the thirtieth day
of June, two thousand seven.
Be it enacted by the Legislature of West Virginia:
That Chapter Six, acts of the Legislature, regular session,
two thousand six, known as the Budget Bill, be supplemented and
amended by amending Title II, section nine, to read as follows:
Sec. 9. Appropriations from surplus accrued.-The following
items are hereby appropriated from the State Excess Lottery
Revenue Fund, and are to be available for expenditure during the
fiscal year 2007 out of surplus funds only, as determined by the
Director of the Lottery, accrued from the fiscal year ending the
thirtieth day of June, 2006, subject to the terms and conditions
set forth in this section.
It is the intent and mandate of the Legislature that the following appropriations be payable only from surplus accrued
from the fiscal year ending the thirtieth day of June, two
thousand six.
In the event that surplus revenues available from the fiscal
year ending the thirtieth day of June, two thousand six, are not
sufficient to meet all the appropriations made pursuant to this
section, then the appropriations shall be made to the extent that
surplus funds are available and shall be allocated first to
provide the necessary funds to meet the first appropriation of
this section; next, to provide the funds necessary for the second
appropriation of this section and subsequently to provide the
funds necessary for each appropriation in succession before any
funds are provided for the next subsequent appropriation.

Connectivity Research and

The above appropriation to Connectivity Research and
Development shall be used by the West Virginia Development Office
for the coordinated development of technical infrastructure in
areas where expanded resources and technical infrastructure may
be expected or required pursuant to the provisions of 5a-6-4 of
the code.
After first meeting all above appropriations made pursuant
to this section, then any remaining surplus accrued balance in
the excess lottery revenue fund as determined and certified by
the Director of the Lottery from the fiscal year ending the
thirtieth day of June, two thousand six, shall be transferred to
the Consolidated Public Retirement Board - West Virginia
Teachers' Retirement System Employers Accumulation Fund (fund
2601).
The purpose of this supplementary appropriation bill is to
supplement, amend, add, and increase items of appropriations in
the aforesaid accounts for the designated spending units for
expenditure during the fiscal year two thousand seven.
