A BILL to amend and reenact §3-1-4 of the Code of West Virginia, 1931, as amended, relating to voter identification; and establishing a requirement that voters identify themselves prior to casting a vote.

Be it enacted by the Legislature of West Virginia:
That §3-1-4 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 1. GENERAL PROVISIONS AND DEFINITIONS.
§3-1-4. Manner of voting.
(a)In all elections the mode of voting shall be by ballot, but the voter shall be left free to vote by either open, sealed, or secret ballot, as he or she may elect. Voting by ballot may be accomplished as provided in articles three, four, five and six of this chapter.
(b) In elections in which a voter appears at a polling place in person, the voter must present his or her State of West Virginia voter's registration card along with one form of government issued photo identification, or in lieu of photo identification, the voter must present a current utility bill, current bank statement, current pay stub or government check.

Note: The purpose of this bill is to establish a requirement that voters identify themselves prior to casting a vote.
