A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18-3-13, relating to redirecting certain funds of the West Virginia Department of Education; requiring the department to transfer an amount equal to one half of the department’s 2017 budget for administrative costs into a special account for the purpose of increasing teacher salaries.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended and reenacted, by adding thereto a new section, designated §18-3-13, to read as follows:

ARTICLE 3. State Superintendent of Schools.

§18-3-13. Department of Education administrative budget; special fund created.


(a) For the purposes of this section, the term “administrative costs” means the amount of funds that the West Virginia Department of Education expended, during the state’s fiscal year beginning in 2017, to maintain the department’s daily operations and administer business, including but not limited to funds used for staff salaries, office space, office supplies and equipment, and utility bills.

(b) For the state’s fiscal year beginning in 2018 and for each fiscal year thereafter, the superintendent shall transfer an amount equal to one half of the West Virginia Department of Education’s administrative costs for the year 2017 into a special account in the State Treasury to be known as the “Teacher’s Salary Improvement Fund.”

(c) Expenditures from the Teacher’s Salary Improvement Fund shall be solely for the purpose of increasing teacher salaries throughout the state.

(d) The State Board of Education shall promulgate legislative rules to distribute the funds from the Teacher’s Salary Improvement Fund to increase teacher salaries in a manner that meets the requirements of article four, chapter eighteen-a of this code.

 

NOTE: The purpose of this bill is to require the West Virginia Department of Education to transfer an amount equal to one half of the department’s 2017 budget for administrative costs into a special account for the purpose of increasing teacher salaries.
