A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18-2-40, relating to state control of county schools; giving the State Board of Education no more than five years to improve any school or school system under its control; and requiring the State Board of Education to hold a public hearing if it seeks to take control of the school or school system within three years of control being relinquished.

Be it enacted by the Legislature of West Virginia:

            That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18-2-40, to read as follows:

ARTICLE 2. STATE BOARD OF EDUCATION.

§18-2-40. State control of county boards of education; improvement by state board; time tables; public hearing.

            (a) The state board may not control a public school, or a public school system, in West Virginia for more than five years. At the end of that five year period the state board shall relinquish control of the school or school system to the county board.

            (b) Once control has been relinquished to the county board, the state board may not intervene again for a minimum of three years unless the state board holds a public hearing in the affected county in order that the concerns of the citizens of that county may be heard.

 


            NOTE: The purpose of this bill is to give the State Board of Education no more than five years to improve any school or school system under its control. The bill requires the State Board of Education to provide a public hearing if it seeks to take control of the school or school system again with three years of control being relinquished.
