A BILL to amend and reenact §8-9-3 of the Code of West Virginia, 1931, as amended, relating to updating the recordkeeping requirements of municipalities.

Be it enacted by the Legislature of West Virginia:

    That §8-9-3 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 9. PROCEEDINGS OF GOVERNING BODIES.

§8-9-3. Governing body to keep records; minutes of proceedings;            voting.

    The governing body of every a municipality shall cause to be kept, in a well-bound book, keep an accurate record of all of its proceedings, ordinances, orders, bylaws, acts, resolutions and rules and regulations which shall be fully indexed and open to inspection. by anyone who is required to pay taxes to such municipality.

    At each meeting of the governing body, a journal of the proceedings of the last meeting shall be read, and corrected, if erroneous, and signed by the presiding officer: for the time being Provided, That the reading of the journal of the proceedings of the last meeting may be dispensed with by majority vote of the governing body if the members thereof have received and examined a copy or synopsis of the journal or a synopsis thereof prior to the meeting at which the journal is signed. Upon the call of Any member may request the yeas and nays be taken on any question shall be taken and recorded in the journal.

 



    NOTE: The purpose of this bill is to update the recordkeeping requirements of municipalities.
