A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §5A-12-1, §5A-12-2, §5A-12-3, §5A-12-4 and §5A-12-5, all relating to green building, encouraging certain state buildings to meet an energy building standard; and requirements for new state office buildings.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article, designated §5A-12-1, §5A-12-2, §5A-12-3, §5A-12-4 and §5A-12-5, all to read as follows:
ARTICLE 12. GREEN BUILDINGS.
§5A-12-1
. Legislative purpose.
(a) The Legislature declares that with energy cost rising and buildings creating an unhealthy work environment for the people working in the building, it is in the public interest that state office buildings and other state buildings be renovated and/or built to be more energy efficient and create a healthy working environment.
(b) Therefore, the Legislature encourages state office buildings and other state buildings to be renovated and/or built to a "Green Buildings" standard.
§5A-12-2. Definitions.
As used in this article, the following words and terms have the following meanings, unless the context clearly indicates otherwise:
(a) "Department" means the Department of Administration.
(b) "LEED standard" means the United States Green Building Council Leadership in Energy and Environmental Design green building rating standard.
(c) "Green Globes" means the Green Building Initiative green building rating standard.
§5A-12-3. Requirements for new state office buildings.
(a) Prior to July 1, 2010, the department is encouraged to build new state office buildings to the LEED standard of silver that is applicable at the time the building project is initiated.
(b) After July 1, 2010, the department is required to build new state office buildings to the LEED standard of silver that is applicable at the time the building project is initiated.
§5A-12-4. Proposals for renovated state office buildings and other state buildings.
(a) After July 1, 2009, the department is encouraged to renovate existing state office buildings to the LEED standard of certified that is applicable at the time the building project is initiated.
(b) After July 1, 2009, the department is encouraged to renovate and/or build other state buildings to the LEED standard or certified that is applicable at the time the building and/or renovation project is initiated.
§5A-12-5. Reporting Requirements.
(a) By January 1, 2012, the department shall report to the Joint Committee on Government and Finance on all state buildings that were built or renovated using the LEED standard.
(b) The report shall include the following for each building that was built or renovated:
(1) The LEED standard that was obtained;
(2) The process required to obtain the LEED standard;
(3) The cost to the state, including cost from prior similar projects compared with the cost incurred in the current project;
(4) The energy savings and any other savings to the state, including savings from prior similar projects compared with the savings incurred in the current project; and
(5) Any other information the department finds relevant.


NOTE: This bill requires the use of the LEED and Green Globes standard for new construction and renovation of state buildings.
