A BILL to amend the Code of West Virginia, 1931,as amended, by adding thereto a new article, designated §7-1-9a, relating to authorizing each county commission to establish a special fund to be used for minor road repair within the county.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article, designated §7-1-9a, to read as follows:

ARTICLE 1.  County commissions generally.

§7-1-9a.  Special road fund for minor road repairs authorized; donations.

Each county commission is authorized to establish for its county, a special fund, to be known as a Special County Road Fund, to receive donations from individuals, private businesses or other private entities to be used for minor road repair made by the Division of Highways within the county.  This section does not grant the commission authority to dictate which repairs the Division of Highways shall make within the county, but, with agreement of the division, the commission may use the money from the special fund to reimburse, partially or fully, costs for minor road repair made within the county by the division.

Notwithstanding provisions of section nine of this article, expenditures from a Special County Road Fund may be used only for repair of roads within the county and money from the fund may not be transferred to the county general fund.

NOTE: The purpose of this bill is to authorize county commissions to establish special funds for minor road repair within their counties.
