A BILL to amend and reenact §18B-2B-3 of the Code of West Virginia, 1931, as amended, relating to abolishing the West Virginia Council for Community and Technical College Education; transferring all powers and duties of the council pertaining to institutions of higher education to the board of governors of the institutions and providing for the transfer and disposition of assets, property and records of the council.

Be it enacted by the Legislature of West Virginia:


That §18B-2B-3 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 2B. WEST VIRGINIA COUNCIL FOR COMMUNITY AND TECHNICAL COLLEGE EDUCATION.


§18B-2B-3. West Virginia Council for Community and Technical College Education abolished.

 (a) The West Virginia Council for Community and Technical College Education is hereby abolished, effective July 1, 2016.  All powers and duties of the West Virginia Council for Community and Technical College Education pertaining to the institutions of higher education in this state shall be transferred to the governing boards of the institutions.

(b)  All monetary assets of the West Virginia Council for Community and Technical College Education shall be transferred into the State’s General Revenue Fund.  All other property of the West Virginia Council for Community and Technical College Education shall be disposed of or transferred in accordance with the requirements of section twelve, article ten, chapter four of this code.


 

NOTE: The purpose of this bill is to abolish the West Virginia Council for Community and Technical College Education; to transfer the power and duties of the council to the governing boards of the institutions of higher education; and to provide for the disposition or transfer of assets and property of the council.
