A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §18B-12-3a, relating to research and development agreements for state institutions of higher education; and designating the Higher Education Policy Commission a state institution of higher education and its chancellor a president for the purpose of entering into research and development agreements.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §18B-12-3a, to read as follows:

ARTICLE 12. RESEARCH AND DEVELOPMENT AGREEMENTS FOR STATE INSTITUTIONS OF HIGHER EDUCATION.

§18B-12-3a. Higher Education Policy Commission.

    For the purposes of this article the Higher Education Policy Commission is considered a “governing board for a state institution of higher education” and its chancellor is considered to be a “president” of a state institution of higher education.

    NOTE: The purpose of this bill is to designate the Higher Education Policy Commission as a state institution of higher education for the purpose of entering into research and development agreements.
