A BILL to amend article six, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section sixteen, relating to compelling appearance to locate an adult who is the subject of an allegation of abuse or neglect.

Be it enacted by the Legislature of West Virginia:

That article six, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section sixteen, to read as follows:

ARTICLE 6. SOCIAL SERVICES FOR ADULTS.

§9-6-16. Compelling appearance.

In order to obtain information regarding the location of an adult who is the subject of an allegation of abuse or neglect, adult protective services may serve, by certified mail, personal service or facsimile, an administrative subpoena on any person, corporation, partnership, business or organization for an appearance or for production of information leading to the location of such adult. In case of disobedience to the subpoena, adult protective services may petition any circuit court to require the appearance and production of information.
