A BILL to amend the code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5A-1-11, relating to the promulgation of rules by the department of administration for compliance standards on all property leased by the state.

Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5A-1-11, to read as follows:
ARTICLE 1. DEPARTMENT OF ADMINISTRATION.
§5A-1-11. Rules for compliance standards for all state leased property.

(a) The secretary of the department of administration has the authority to propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code regarding specific compliance standards related to all new and existing leases for state property in order to ensure a competitive bidding process.
(b) The rules shall:
(1) Encompass the selection process; and
(2) Provide a time frame for existing leases to comply with the new standards which compliance standards shall be in force throughout the term of the lease.
(c) The initial rules promulgated under this section may be proposed as emergency rules for approval in accordance with the provisions of article three, chapter twenty-nine-a of this code.

JUDICIARY COMMITTEE AMENDMENT


On page two, section eleven, lines eight and nine, by striking out the words "the new standards which compliance standards shall be in force throughout the term of the lease" and inserting in lieu thereof the words "any new compliance standards".
