A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §8-22A-28a, relating to allowing a police or fire department that did not initially join the West Virginia Municipal Police and Firefighters Retirement System an opportunity to do so.

Be it enacted by the Legislature of West Virginia:

ARTICLE 22A. WEST VIRGINIA MUNICIPAL POLICE OFFICERS AND FIREFIGHTERS RETIREMENT SYSTEM.

§8-22A-28a. Opportunity to join the Municipal Police and Firefighters Retirement System.

(a) Subject to complying with the requirements of §8-22A-28, and any other requirements the Consolidated Public Pensions Board considers necessary, a municipal police or fire department may join the system established by this article.

(b) The Consolidated Public Pensions Board shall determine all questions of transfer of funds between the retirement system to which the department may now belong and this system including any additional funds that may need to be contributed, years of service to be credited, compliance with all federal laws, and any other conditions that must be met.

NOTE: The purpose of this bill is to allow municipal police or fire departments which have not previously joined the state municipal police and firefighters retirement system an opportunity to do so.
