A BILL to amend article two, chapter seventeen-b of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nine-a, relating to exempting certain railroad employees
from duty to produce a driver's license and prohibiting
citation reports to the division.
Be it enacted by the Legislature of West Virginia:
That article two, chapter seventeen-b of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
nine-a, to read as follows:
ARTICLE 2. ISSUANCE OF LICENSE, EXPIRATION AND RENEWAL.
§17B-2-9a. Exemptions of certain railroad workers.
In any circumstances involving accidents or violations in
which the engineer or any other crew member of any train is detained by state or local police, the engineer or any crew
member shall not be required to furnish a motor vehicle license,
nor shall any citation involving the operation of a train be
issued against the motor vehicle operator license of the engineer
or any other crew member of the train.
NOTE: The purpose of this bill is to prevent law
enforcement from improperly reporting train operation infractions
by on-duty railroad employees as violations on public highways.
