A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §61-2-9d, relating to
the crime of soliciting or attempting to solicit a child into
a motor vehicle near a school; and providing a felony criminal
penalty.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §61-2-9d, to read as
follows:
ARTICLE 2. CRIMES AGAINST THE PERSON.
§61-2-9d. Soliciting, etc. a child near a school; penalty.
_____Any person who solicits, entices, seduces or lures, or
attempts to solicit, entice, seduce or lure a minor sixteen years
of age or younger into a motor vehicle within one thousand feet of
a school for any illegal or illicit purpose is guilty of a felony
and, upon conviction thereof, shall be fined not more than $5,000 or imprisoned in a state correctional facility not less than two
nor more than ten years, or both imprisoned and fined.
NOTE: The purpose of this bill is to create the crime of
soliciting or attempting to solicit a child into a motor vehicle
near a school for any illegal or illicit purpose. The bill also
provides a felony criminal penalty.
