A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §21-3-21, relating to
creating a special revenue fund for the provision of
occupational safety and health initiatives.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
and reenacted by adding thereto a new section, designated §21-3-21,
to read as follows:
ARTICLE 3. SAFETY AND WELFARE OF EMPLOYEES.
§21-3-21. Special Revenue Fund for the Division of Labor;
authorized deposits; disbursements; purpose.
There is hereby created in the state treasury a special
revenue fund to be known as the "Occupational Safety and Health
Fund" which shall consist of all gifts, grants, bequests,
transfers, appropriations or other donations or payments which may
be received from any governmental entity or unit or any person, firm, foundation, or corporation, and all interest or other return
earned from investment of the fund. Expenditures from the fund
shall be made by the Commissioner of the Division of Labor to
provide matching funds, or to reimburse the Division of Labor for
providing matching funds, to obtain federal funds for the
administration of an occupational safety and health consultation
program under contract with the federal Department of Labor.
NOTE: The purpose of this bill is to create a special revenue
account for the
operation of the Occupational Safety and Health
Program within the Division of Labor.
