A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated section §7-1-3oo,
relating to authorizing a county to hire a blasting
enforcement officer.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-1-3oo, to read as
follows:
ARTICLE 1. COUNTY COMMISSIONS GENERALLY.
§7-1-3oo. Authority of counties to hire an blasting enforcement
officer.
(a) A county commission that has enacted a county wide zoning
ordinance pursuant to the provisions of article seven, chapter
eight-a of this code and is a growth county pursuant to the
provisions article twenty, chapter seven of this code, may adopt an
ordinance to enter into an agreement with the state fire marshal to hire, with the approval of the state fire marshal, a blasting
enforcement officer to assist the state fire marshal in
investigating and enforcing the state fire commission's rules on
explosives and blasting in that particular county.
(b) This blasting enforcement officer is strictly prohibited
from investigating or enforcing any law or rule in connection with
any mining or blasting activities regulated by any agency or
authority other than the State Fire Marshal.
