A BILL to amend article twenty-nine, chapter thirty of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
ten, relating to requiring any police agency of a political
subdivision that hires a person within twenty-four months of
his or her training at the state police academy to pay a
percentage of the cost to the sponsoring agency of such
training to the police agency that sponsored and funded the
recruit's training based upon months remaining until twenty- four months have passed.
Be it enacted by the Legislature of West Virginia:
That article twenty-nine, chapter thirty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section ten,
to read as follows:
ARTICLE 29. LAW-ENFORCEMENT TRAINING AND CERTIFICATION.
§30-29-10. Requirement for police agency to pay proportional
cost of graduate's training at the state police academy upon
hiring a graduate sponsored by a different police agency.
Notwithstanding any provision of law to the contrary, in the
event a police agency of a political subdivision of this state
hires any graduate recruit of the state police academy that was
sponsored by a different police agency within twenty-four months
of the recruit's graduation from the academy, the police agency
that hires the graduate shall pay the sponsoring police agency
the fractional proportion of the total cost of training to the
sponsoring agency of the recruit, based upon the total cost
distributed over a twenty-four month period. The amount due for
the training shall be calculated after ascertaining the remaining
period of time from the date of such hire until twenty-four
months have elapsed:
Provided, That for purposes of this
section, the total cost of training shall consist of the cost of
the salary and benefits paid by the sponsoring agency for the
period of training of the recruit and any tuition paid by the
sponsoring agency for the recruit.
