A BILL to amend article fifteen, chapter seventeen-c of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
fifty, relating to traffic regulations and laws of the road;
and requiring persons transporting compressed gas containers
to secure the containers.
Be it enacted by the Legislature of West Virginia:
That article fifteen, chapter seventeen-c of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
fifty, to read as follows:
ARTICLE 15. EQUIPMENT.
§17C-15-50. Vehicles transporting compressed gas containers.
Any person operating any vehicle transporting any container
of compressed gas as a cargo or part of a cargo upon a highway in an open motor vehicle shall at all times comply with the
provisions of this section. The containers shall be secured and
capped in a manner determined by the commissioner by rule for
safe transport and may not be transported with any gauges
attached to the containers.
The commissioner of highways is hereby authorized and
directed to promulgate rules governing the transportation of
compressed gas containers by vehicles upon the highways as the
commissioner deems advisable for the protection of the public.
NOTE: The purpose of this bill is to require that persons
transporting compressed gas containers in open motor vehicles cap
and secure them and transport them without gauges attached.
