A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §5B-1-1a, relating to
creating the Marketing and Communications Office to be
administered by the Department of Commerce; providing
marketing and communications goods and services to other state
agencies; setting fees; creating a special revenue account;
providing for expenditure of funds; and providing sunset
provisions.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §5B-1-1a, to read as
follows:
ARTICLE 1. DEPARTMENT OF COMMERCE.
§5B-1-1a. Marketing and Communications Office.
(a) The Marketing and Communications Office is created to
provide marketing and communications goods and services to other
state agencies. The office may charge for these goods and services
pursuant to a fee schedule approved by the Secretary of Commerce.
(b) Each agency, department, unit of state or local government
or any other entity or person for which marketing and communication
services are provided shall transmit to the Secretary of Commerce
for deposit in the fund the charges made by the Secretary of
Commerce.
(c) There is created a special revenue account, designated the
Department of Commerce Marketing and Communications Operating Fund,
for the operation of a marketing and communications office within
the office of the Secretary of Commerce.
(d) This fund shall be an interest bearing account and shall
be invested pursuant to section nine-c, article six, chapter twelve
of this code with the interest income a proper credit of the fund.
The fund shall consist of all interest or return on investment
accruing to this account, funds received for marketing and
communications goods and services rendered to other agencies,
departments, units of state and local government and any other
entity and any appropriations by the Legislature which may be made
for purposes described in this section.
(e) Any balance including accrued interest and other earnings at the end of any fiscal year shall not revert to the General
Revenue Fund but shall remain in the fund for the purposes set
forth in this section.
(f) Expenditures from the fund are authorized from collections
and shall be expended at the discretion of the Secretary of
Commerce for the administration of the provisions of this section.
(g) Pursuant to the provisions of article ten, chapter four of
this code, the Marketing and Communications Office shall continue
to exist until the first day of July, two thousand ten, unless
sooner terminated, continued or reestablished.
