A BILL to amend article two, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section five-d,
relating to school bus transportation time limits.
Be it enacted by the Legislature of West Virginia:
That article two, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section five-
d, to read as follows:
ARTICLE 2. STATE BOARD OF EDUCATION.
§18-2-5d. School bus transportation time limits.
No elementary school pupil may be required to ride a school
bus for longer than thirty-five minutes to school or longer than
thirty-five minutes from school; no middle school pupil may be
required to ride a school bus for longer than forty-five minutes
to school or longer than forty-five minutes from school; and no
high school pupil may be required to ride a school bus for longerthan fifty-five minutes to school or longer than fifty-five
minutes from school unless the state board of education, after
review on a case by case basis, waives this requirement. All
counties which receive a waiver must submit by the first day of
January of the year of the waiver a plan which shall correct the
deficiency.
NOTE: The purpose of this bill is to restrict, unless a
waiver is obtained, the time that pupils are required to ride on
school buses.
