A BILL to authorize and empower the State of West Virginia to transfer Little Beaver State Park in Raleigh County to the Raleigh County Commission.

Be it enacted by the Legislature of West Virginia:


RALEIGH COUNTY

§1. The State authorized to transfer certain real estate in Raleigh County.

The State of West Virginia is authorized to transfer and sell to the Raleigh County Commission that certain tract and parcel of land known as Little Beaver State Park owned by the State of West Virginia situate in Beaver, West Virginia, comprised of 562 acres on which are located an 18-acre lake, hiking trails, roads, a park office, a park camp store, camping sites, bath house, dumping station, picnic tables, grills and miscellaneous appurtenances belonging thereto, to be used as county park and recreation area and for other related purposes.

The Legislature hereby finds and declares that the sale and conveyance of Little Beaver State Park to the Raleigh County Commission for continued and additional recreational purposes and development is in the best interests of the State of West Virginia and the Raleigh County Commission. Little Beaver State Park is particularly situated in Raleigh County for the Raleigh County Commission to further develop the property for the recreational and economic interests and the good will of the county and the communities in close proximity to the park that will produce tax revenue for the county .

The Legislature hereby finds and declares that in the particular instances existing in regard to this parcel of real estate, the method of accomplishing its economic development, which is declared to be a public purpose and in the best interests of the State of West Virginia and Raleigh County, would be best accomplished by the method set forth in this section.

§2. Date; conditions.


The conveyance of that 562-acre parcel of land, along with all buildings, facilities, appurtenances, and improvements, collectively known as Little Beaver State Park, shall be completed by July 1, 2021, on terms and conditions acceptable to both the State of West Virginia and the Raleigh County Commission, including the commission agreeing to adhere to, and its management of the property be consistent with, the guidelines and requirements of the Land and Water Conservation Fund that may only be used for parks and recreation.

 

NOTE: The purpose of this bill is to authorize the State of West Virginia to sell, transfer and convey the 562-acre Little Beaver State Park to the Raleigh County Commission.
