SENATE CONCURRENT RESOLUTION NO. 14

Approving and authorizing the use of closure cost assistance fund
moneys for the safe closure of landfills in accordance with
the plan submitted by the office of waste management of the
division of environmental protection.
Whereas, This Legislature did enact Senate Bill No. 18 in
October, 1991, to comprehensively regulate and manage solid
waste; and
Whereas, The governor did sign said legislation and it
became law; and
Whereas, The legislation at section thirteen, article
five-n, chapter twenty of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, did require a statewide
closure plan to be developed by the division of environmental
protection in consultation with the public service commission;
and
Whereas, The plan was developed and timely submitted to the
Legislature; therefore, be it
Resolved the the Legislature of West Virginia:
That the plan so submitted is approved and spending for the
statutory purposes is authorized and may commence from passage of
this resolution; and, be it
Further Resolved, That the division of environmental
protection shall report annually by the thirty-first day of
December, one thousand nine hundred ninety-three, and each year
thereafter, how funds have been spent in that year and how funds
are projected to be spent in the next fiscal year until all funds
are spent or all landfills are closed and all post-closure
monitoring periods have expired; and, be it
Further Resolved, That the Clerk of the Senate is hereby
directed to forward a copy of this resolution to David C.
Callaghan, director of the division of environmental protection.
