A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §61-8B-6, relating to
creating the offense of sexual battery.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §61-8B-6, to read as
follows:
ARTICLE 8B. SEXUAL OFFENSES.
§61-8B-6. Sexual Battery.
(a) Any person who, without consent, subjects another person
to any sexual contact, as defined in this article, is guilty of
sexual battery.
(b) Sexual battery is a misdemeanor punishable by confinement
in jail for not more than one year, or a fine of not more than one
thousand dollars, or both.
NOTE: The purpose of this bill is to create the offense of
sexual battery; and to provide a penalty.
